Allahabad High Court

RAMSAMUSHversusSTATE OF U.P.

Decided

Holding

The court granted bail to the applicant on the ground of parity with a co‑accused who had already been released on bail.

Summary

The applicant, Ramsamush, was charged under Sections 8, 22, 23 and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act in Criminal Case No. 131 of 2026, with two cases filed against him simultaneously. A co‑accused, Naveen Kumar Gautam, had earlier been released on bail by the same court in a related bail application. The applicant’s counsel sought bail on the ground of parity with the co‑accused, arguing that there was a prima facie case for release during the pendency of trial. The court, after hearing both sides, noted the earlier bail order and, without expressing any view on the merits of the charges, held that the applicant satisfied the criteria for bail. Accordingly, the court granted bail subject to a personal bond, two sureties, and conditions not to tamper with evidence, intimidate witnesses, and to appear as required, with a warning that breach would lead to cancellation.

Issues considered

  • Whether bail can be granted to an accused under the NDPS Act during the pendency of trial.
  • Whether the principle of parity with a co‑accused who has already been released on bail warrants granting bail to the applicant.
