Allahabad High Court

KHUSHBUversusSTATE OF U.P.

Decided

Holding

Bail was granted to the applicant.

Summary

The Allahabad High Court considered a bail application filed by Khushbu, who is accused in Criminal Case No. 87 of 2026 under IPC sections 137(2), 3(5), 142 and 143(4) for alleged child abduction. Counsel for the applicant contended that she is innocent, that there is no direct evidence against her, and that she should be granted bail on the same footing as co‑accused who had already obtained bail. The State opposed the application but did not dispute the factual submissions. Weighing the nature of the allegation, the period of custody and the gravity of the offence, the court held that the case is fit for bail without expressing an opinion on the merits. Accordingly, bail was granted on a personal bond and two sureties, subject to conditions prohibiting evidence tampering, intimidation of witnesses, further offences and inducement of persons acquainted with the facts, with the power to cancel bail on breach.

Issues considered

  • Whether bail should be granted to the accused Khushbu in a child‑abduction case under IPC sections 137(2), 3(5), 142 and 143(4) considering the lack of direct evidence and parity with co‑accused who have been released on bail.
