Allahabad High Court

OMVEER AND ANOTHERversusSTATE OF U.P.

Decided

Holding

Bail was granted to applicant no.2 (Kishanpal alias Kushanpal) subject to personal bond, sureties and conditions.

Summary

The High Court considered a bail application (Criminal Misc. Bail Application No. 23922 of 2026) filed by Omveer and Kishanpal alias Kushanpal, who were accused in a case under IPC sections 310(2), 317(3) and 61(2). The applicants claimed innocence, argued that the FIR named unknown persons and that the recovery alleged against them was false, and highlighted that co-accused had already been granted bail. The State opposed bail but did not dispute these contentions. After reviewing the facts, the Court, without opining on the merits, found the case fit for bail and ordered the release of Kishanpal on personal bond and two sureties, imposing standard conditions. The order clarified that the observations were limited to bail and would not affect the trial's merits.

Issues considered

  • Whether bail should be granted to the accused Kishanpal alias Kushanpal despite the serious nature of the charges under IPC sections 310, 317 and 61.
  • Whether the applicant's criminal history and current incarceration preclude the grant of bail.
