The court held that the applicant is entitled to be released on bail during the pendency of the trial.
Summary
The High Court considered a bail application filed by Mujayyan, who was in custody since 1 June 2026 in a criminal case (Crime No. 206 of 2026) involving offences under Sections 318(4), 319(2), 351(2), 338 and 3(5) of the Indian Penal Code. The applicant claimed innocence, alleging false implication and that he was a victim of a transaction with the informant, and asserted no monetary benefit or participation in the alleged crime. The State, represented by the Additional Government Advocate, opposed bail, citing the seriousness of the charges. After reviewing the record, the court found no reason to deny bail and, without commenting on the merits, ordered the applicant’s release on personal bond with two sureties, subject to standard conditions to prevent evidence tampering, witness intimidation, and further offences. The order also directed verification of sureties’ identity and residence and warned that breach of conditions could lead to cancellation of bail.
