Allahabad High Court

MAHESH PAL SINGHversusSTATE OF U.P.

Decided
Bench
MUNIR

Holding

The bail application is dismissed as infructuous due to the supervening conviction and life sentence.

Summary

Mahesh Pal Singh, convicted of offences under Sections 302, 34 and 120B of the IPC and sentenced to life imprisonment, had filed a bail application (No. 24460 of 2021) before the High Court of Allahabad. The District Judge submitted a compliance report and an affidavit from the Senior Superintendent of Police confirming the conviction. The High Court noted the supervening event of the conviction and accepted the explanation for the lapse in the earlier order. Consequently, the Court held that the bail application could no longer be entertained and dismissed it as infructuous. The order was directed to be communicated to the police through the Chief Judicial Magistrate within 48 hours.

Issues considered

  • Can a bail application be entertained after the applicant has been convicted and sentenced to life imprisonment?
  • Does the occurrence of a supervening conviction render a pending bail application infructuous?
