- JAI PRAKASH TIWARI
Holding
The bail application is allowed, and the applicant is released on bail subject to conditions.
Summary
The High Court considered a bail application filed by Aalim Ali, who was in custody since 8 July 2026 for offences under Sections 420, 465, 467, 468 and 471 of the Indian Penal Code, with an earlier FIR under Section 409 later dropped. The applicant claimed false implication, asserted that no honorarium was received, and highlighted his prior criminal history, which he explained in the application. The State opposed bail but did not contest the applicant’s factual contentions. After reviewing the record and the nature of the allegations, the Court, without expressing an opinion on the merits, found the case suitable for bail and imposed standard conditions. Consequently, the Court ordered the applicant’s release on bail upon furnishing a personal bond and two reliable sureties, subject to conditions of appearance, non‑interference with witnesses, and abstention from criminal activity.
Issues considered
- Whether bail should be granted to the accused in a case involving offences under Sections 420, 465, 467, 468 and 471 IPC, considering the alleged false implication and the applicant’s prior criminal history.
