Allahabad High Court

PRASHANT KUMARversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, given the lack of substantive evidence, his clean record, and the need to address jail overcrowding.

Summary

The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Prashant Kumar, who was charged under Section 69 BNS for allegedly establishing a false marital promise and a consensual relationship with a 25‑year‑old woman. The applicant contended that the victim’s statements under Sections 180 and 183 BNS were contradictory, there was no medical evidence of rape or pregnancy, and he had no prior criminal record, having been in custody since 25 May 2026. The State opposed bail, citing the seriousness of the alleged offence. The Court, referencing the Supreme Court’s guidelines in Kapil Wadhawan v. CBI (2025) and Maya Tiwari v. State of U.P. (2024), as well as the policy on bail from the 2023 Suo Motu writ, held that the applicant was entitled to bail given the lack of substantive evidence, his clean record, and the need to alleviate jail overcrowding. Accordingly, the Court ordered his release on bail subject to a personal bond, two sureties, and specific conditions, directing verification of identities and electronic transmission of the order.

Issues considered

  • Whether bail should be granted to the accused under Section 483 BNS in view of the alleged offence and the evidentiary material.
  • Whether contradictions in the victim’s statements and absence of medical evidence affect the bail decision.
  • Whether considerations of jail overcrowding and pendency of cases justify granting bail.
