Holding
The bail application is allowed.
Summary
Arvindpal Singh, a branch manager, was arrested in connection with a 2024 case (Crime No. 217) involving alleged offences under Sections 420, 467, 468, 471 and 120B of the IPC. He filed a bail application, claiming he was falsely implicated, that the loan in question was sanctioned based on a report from a bank panel lawyer who now denies signing it, and that the FIR was lodged seven years after the incident. The applicant also highlighted his nine prior criminal cases but argued that he would not misuse bail and would cooperate with the trial. The Additional Government Advocate opposed bail but did not dispute the applicant's contentions. After considering the circumstances, the court, without expressing an opinion on the merits, found the case fit for bail and ordered his release on personal bond and two sureties with standard conditions. The order expressly limited its observations to the bail application and stated that any breach could lead to cancellation of bail.
Issues considered
- Whether bail should be granted to the accused in a case involving offences under Sections 420, 467, 468, 471 and 120B of the IPC.
- Whether the delay of seven years in lodging the FIR and the alleged false implication affect the bail decision.
- Whether the applicant's prior criminal history precludes the grant of bail.
