Allahabad High Court

SANJAYversusSTATE OF U.P.

Decided
Bench
MUNIR

Holding

The bail application was dismissed as infructuous because the applicant had already been acquitted.

Summary

The applicant, Sanjay, filed a bail application in the Allahabad High Court. The court examined a report from the Superintendent of Police showing that the Additional District Judge/Fast Track Court in Hapur had acquitted the applicant in Sessions Trial No. 32 of 2017, which involved offences under Sections 406, 420, 376D and 506 IPC. Because the acquittal constituted a supervening event, the bail application could no longer be entertained. The court therefore held the bail application to be infructuous. Consequently, the application was dismissed as infructuous.
