Allahabad High Court

SUSHIL MAURYAversusSTATE OF U.P.

Decided

Holding

The bail application is allowed and the accused is released on personal bond and sureties.

Summary

The accused Sushil Maurya applied for bail in a criminal case (Crime No. 170 of 2024) involving offences under Sections 467, 468, 471, 420, 406, 506 and 120‑B of the Indian Penal Code, alleging that he took money to secure a government job for the informant's son. He has three other criminal cases, is presently in jail since 19‑03‑2025, and seeks release pending trial. The State opposed bail but did not dispute the factual allegations. The High Court, after hearing counsel for both sides, allowed the bail application without addressing the merits, relying on Supreme Court guidelines in Girish Gandhi v. State of Uttar Pradesh (2024) 10 SCC 674 and Policy Strategy for Grant of Bail in Re (2024) 10 SCC 685. The court ordered the applicant to be released on personal bond and two sureties, and directed cooperation with the judicial process for speedy disposal.

Issues considered

  • Whether bail should be granted in a case involving serious IPC offences such as forgery, cheating, criminal breach of trust and criminal conspiracy, considering the applicant's prior criminal history.
  • Whether the Supreme Court's recent bail guidelines in Girish Gandhi v. State of Uttar Pradesh and Policy Strategy for Grant of Bail in Re are applicable to this case.
