Allahabad High Court
JITENDRA @ JITUversusSTATE OF U.P.
- Decided
Holding
The Court held that bail should be granted to the applicant under the applicable provisions.
Summary
The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Jitendra @ Jitu, who was charged under Sections 8 and 20 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for allegedly possessing 34.5 kg of ganja. The applicant claimed innocence, alleging that the seized narcotics were weighed improperly and that mandatory provisions of Sections 50 and 52‑A of the NDPS Act were not complied with. The State opposed bail, emphasizing the seriousness of the offence and the alleged procedural lapses. The Court, referring to Section 37 of the NDPS Act and the precedent set in Union of India v. Shiv Shanker Kesari (2007) 7 SCC 798, found the case suitable for bail without expressing any view on the merits. Consequently, the bail application was allowed subject to a personal bond of Rs. 50,000 and two sureties, along with strict conditions to prevent tampering with evidence or intimidation of witnesses.
Issues considered
- Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case involving alleged possession of 34.5 kg of ganja under the NDPS Act.
- Whether the alleged non‑compliance with Sections 50 and 52‑A of the NDPS Act affects the grant of bail.
- Whether the weight‑measurement procedure of the seized narcotics impacts the bail decision.
