Allahabad High Court

MANGAL SINGHversusSTATE OF U.P.

Decided

Holding

The court allowed the bail application, granting bail subject to strict conditions.

Summary

Mangal Singh, a Home Guard, was arrested on a FIR alleging that he stole a service revolver, invoking Sections 305(e) and 317(2) of the Indian Penal Code. He filed a bail application claiming innocence, false implication, and lack of independent evidence, and has been in custody since 17 June 2026. The State opposed bail, but the court examined the record, the nature of the allegations, and the applicant's criminal history as set out in a supplementary affidavit. Considering the heavy pendency of cases and the applicant's willingness to comply with conditions, the court decided that bail could be granted without expressing a view on the merits. The bail was ordered on personal bond with two sureties, subject to conditions against tampering with evidence, intimidating witnesses, and committing similar offences. The order expressly limited its observations to the bail application and stated that any breach could lead to cancellation of bail.
