Allahabad High Court
SHAHRUKHversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The Allahabad High Court considered a bail application filed by Shahrukh, who was arrested in a rape case (Criminal Case No. 193 of 2026) under Sections 87, 69 and 351(2) of the Indian Penal Code. The applicant argued that the victim, a major married woman, had consented and that the medico‑legal report did not substantiate a rape, and he had no prior criminal record. The State opposed bail, contending the seriousness of the offence. Referring to Supreme Court precedents on bail, the court noted the lack of medical evidence, the applicant's clean record, and the problem of jail overcrowding, and decided to grant bail without passing on the merits. The bail was ordered with a personal bond, two sureties and specific conditions, and directions were given for verification and prompt release.
Issues considered
- Whether bail should be granted to an accused in a rape case where the victim's statement suggests consent and the medico‑legal report is inconclusive.
- Whether the applicant's lack of criminal history and the circumstances of jail overcrowding justify bail under the prevailing legal standards.
