Allahabad High Court

SARMANversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

The Allahabad High Court considered a bail application filed by Sarman in Criminal Case No.135 of 2025, which is based on Sections 103(1) and 238. The case rests on circumstantial evidence; the FIR did not name any accused and the applicant was implicated solely on suspicion and his own confessional statement, with no other evidence or disclosed motive. The applicant has no prior criminal record and has been in custody since 7 October 2025. The State opposed bail but did not contest the factual submissions. The Court held that, in view of the lack of substantive evidence and the applicant's clean record, he is entitled to bail, subject to a personal bond, sureties, and specific conditions.

Issues considered

  • Whether bail should be granted in a case where the prosecution's case is purely circumstantial, based only on a confessional statement and suspicion, with no disclosed motive.
  • Whether the applicant's lack of prior criminal history and prolonged pre‑trial detention justify bail.

Subjects

  • bail
  • circumstantial evidence
  • confessional statement
  • no prior criminal record
  • suspicion
  • pre‑trial detention
  • bail conditions
