Allahabad High Court
IBRAHIM ANSARIversusSTATE OF U.P.
- Decided

- KRISHAN PAHAL
Holding
The court held that the applicant made out a prima facie case for bail and therefore granted bail.
Summary
Ibrahim Ansari applied for bail in a case involving alleged offences under the Indian Penal Code, the Information Technology Act and the Aadhaar Card Act. He claimed he was falsely implicated, stating that no fake driving licence was recovered from him and that the two laptops seized were not evidence of wrongdoing. The State opposed the bail, but the court noted the absence of a fake licence and, without delving into the merits, found a prima facie case for bail. Consequently, the court granted bail on the condition of a personal bond, two sureties, and compliance with standard bail conditions. The order emphasized that any breach would lead to cancellation of bail and would not affect the trial on merits.
Issues considered
- Whether the applicant is entitled to bail during the pendency of trial for the offences alleged under the IPC, IT Act and Aadhaar Card Act.
- Whether the absence of a recovered fake driving licence establishes a prima facie case for bail.
