Allahabad High Court

HANEEFversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail as the case is fit for bail considering the nature of the allegations, period of custody, and parity with co‑accused.

Summary

The High Court considered a bail application filed by Haneef, who is accused in a criminal case under IPC sections 318(4), 338, 336(3) and 340(2). The applicant claimed innocence, alleged false recovery, and pointed to the fact that co‑accused Javed and Abid had already been granted bail, seeking parity. The State opposed bail but did not refute the applicant’s submissions. After weighing the nature of the allegations, the period of custody, and the similarity of the applicant’s case to that of the co‑accused, the Court, without expressing an opinion on the merits, found the case fit for bail. Consequently, the Court ordered the applicant’s release on bail subject to standard conditions, reserving the right to cancel bail on breach.

Issues considered

  • Whether the applicant is entitled to bail despite being charged with serious offences under IPC sections 318(4), 338, 336(3) and 340(2)
  • Whether the grant of bail to co‑accused on similar charges creates a parity ground for granting bail to the applicant
