Allahabad High Court

MOHAMMAD FAIZAN ALIAS FAIZANversusSTATE OF U.P.

Decided

Holding

Bail was granted to the applicant subject to a personal bond, two sureties and standard conditions.

Summary

The applicant, Mohammad Faizan, filed a bail application in a case registered under Sections 2 and 3 of the U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, alleging that he was falsely implicated due to police rivalry. He had already been granted bail in a related gang‑chart case and claimed no prior criminal record, having been in custody since 8 August 2026. The applicant argued that the prosecution was based on a single criminal case and that he was not a gang member. The State opposed the bail but did not present any substantive counter‑argument. The court, without delving into the merits, allowed the bail on the condition of a personal bond, two sureties, and compliance with standard conditions such as non‑tampering with evidence and appearance before the trial court. The bail may be cancelled if any condition is breached.

Issues considered

  • Whether bail can be granted to the accused under Sections 2/3 of the U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986 despite the seriousness of the offence.
  • Whether the applicant’s claim of false implication and lack of criminal history warrants bail.
