Allahabad High Court

GULZARversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail as the case is fit for bail, considering the facts, parity with the co‑accused, and the period of custody.

Summary

The High Court considered the bail application of Gulzar, who was in custody since 20 June 2026 in a case under IPC sections 109(1), 333, 131 and 351(3). The applicant's counsel argued that he was falsely implicated, that the injuries were not life‑threatening, and that a co‑accused had already been granted bail, invoking parity. The State opposed bail but did not refute the factual submissions. After weighing the nature of the allegations, the gravity of the offences, the period of custody and the principle of parity, the Court found the case fit for bail without expressing a view on the merits. Consequently, the Court ordered the release of Gulzar on personal bond and two sureties, subject to standard bail conditions.

Issues considered

  • Whether the applicant is entitled to bail despite the seriousness of the charges under IPC sections 109, 333, 131 and 351(3)
  • Whether parity with a co‑accused who was granted bail warrants granting bail to the applicant
  • Whether the period of custody and nature of the alleged offences justify the grant of bail
