Allahabad High Court
UPKAR ALIAS JHALAKversusSTATE OF U.P.
- Decided
- Bench
- AVNISH SAXENA
Holding
Since the accused was not named in the FIR and his identification was delayed, he is entitled to bail, and the application is allowed.
Summary
The High Court considered a bail application filed by Upkar alias Jhalak in Criminal Case No. 772 of 2026, where the FIR dated 15‑07‑2026 described an assault on four persons but did not name the applicant. The applicant argued that he was not mentioned in the FIR, that his identification was made later under Section 180 of the CrPC, and that he has been cooperating with the investigation. The State opposed bail, emphasizing the seriousness of the injuries and the later identification of the applicant. The Court examined the applicant’s lack of naming in the FIR, the delay in his identification, and prevailing bail jurisprudence, and decided not to delve into the merits of the case. Accordingly, the Court granted bail on personal bond and sureties, directing the applicant to cooperate with the judicial process.
Issues considered
- The applicant’s name was not mentioned in the FIR; can bail be granted despite later identification under Section 180?
- Do the serious injuries sustained by the victims preclude the grant of bail?
- Whether the provisions of the CrPC and IPC cited justify denial of bail.
