Allahabad High Court

SHAILESH YADAVversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The applicant is entitled to be released on bail.

Summary

Shailesh Yadav applied for bail in a case (Crim. No. 227 of 2026) alleging offences under Sections 64, 115(2), 352, 351(3) and 127(4) of the IPC, including rape and confinement of a 31‑year‑old married woman. The applicant contended that the victim was a consenting party, that the medico‑legal report did not support a rape allegation, and that he had been falsely implicated and had no prior criminal record. The prosecution argued that the applicant had enticed, confined the victim for 27 days and committed rape. The Court, taking note of overcrowded jails, pendency of trials, and the Supreme Court precedents in Kapil Wadhawan v. CBI (2025) and Maya Tiwari v. State of U.P. (2024), held that bail could be granted without expressing a view on the merits. Accordingly, the bail application was allowed subject to a personal bond, two sureties and strict conditions to prevent tampering with evidence or further criminal activity.

Issues considered

  • Whether bail should be granted to the accused despite the serious nature of the alleged offences
  • Whether the victim's alleged consent and the lack of medico‑legal evidence negate the charge of rape
  • Whether the risk of evidence tampering or further offences warrants denial of bail
