Allahabad High Court

KALLUversusSTATE OF U.P.

Decided

Holding

The second bail application is dismissed as no new material facts have been presented and the first bail petition was already rejected.

Summary

The applicant, Kallu, filed a second bail petition (Criminal Misc. Bail Application No. 30980 of 2026) after his first bail petition (No. 6069/2026) had been dismissed on 2 July 2026. He is charged under IPC sections 103(1), 351(3), 352 and under sections 3, 25 and 27 of the Arms Act for offences alleged to have occurred in Shahjahanpur district. The applicant’s counsel argued that he is innocent, that the trial has not yet commenced and that no forensic report is available, seeking release on bail. The respondent’s counsel contended that the second petition offers no new material facts and that the offences are cognizable, warranting denial of bail. The court examined the bail principles and found that the applicant had not presented any fresh evidence or changed circumstances since the first dismissal. Consequently, the court dismissed the second bail application, leaving the applicant in custody.

Issues considered

  • Whether the applicant is entitled to bail in the second bail application despite the earlier dismissal of his first bail petition.
  • Whether any new material facts or changed circumstances have been presented to justify granting bail.
  • Whether the nature of the alleged offences under the IPC and Arms Act warrants denial of bail.
