Allahabad High Court
WALI MAQSOOD RABBANI @ FAIZAL @ FAZALversusSTATE OF UP AND 3 OTHERS
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The High Court considered a bail application filed by Wali Maqsood Rabbani, who was allegedly implicated in a rape case under the POCSO Act after a seven‑day delay in filing the FIR and without being named in the victim's statement. The applicant argued false implication, lack of criminal history, and cited that a co‑accused had already been granted bail. The State opposed bail but did not dispute the factual background. Relying on the Supreme Court’s guidelines in Kapil Wadhawan v CBI (2025), Maya Tiwari v State of U.P. (2024), and the policy on bail (2021), the Court held that the applicant is entitled to bail, subject to standard conditions. Consequently, the bail application was allowed, with the applicant required to furnish a personal bond, two sureties, and comply with conditions prohibiting tampering with evidence, criminal activity, and ensuring cooperation with the trial.
Issues considered
- Whether bail should be granted in a serious offence (rape under POCSO) where the FIR was lodged after a delay and the accused is not named in the victim's statement.
- Whether the applicant's alleged false implication and clean criminal record justify bail.
- Whether the precedents on bail grant and the policy on overcrowded jails apply to this case.
