Allahabad High Court
VISHAL GUPTAversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
Vishal Gupta was arrested in Crime No. 309 of 2026 under IPC sections 69, 352 and 351(2) for allegedly establishing a physical relationship on a false promise of marriage. The victim, a 21‑year‑old woman, recorded a statement under CrPC sections 180 and 183 indicating she was a consenting party and refused a medico‑legal examination. Gupta, who has no prior criminal record and has been in custody since 14 June 2026, sought bail, arguing false implication and lack of evidence of non‑consent. The State opposed bail but did not dispute the factual matrix. Relying on the principles laid down in Kapil Wadhawan v. CBI (2025), Maya Tiwari v. State of U.P. (2024) and the Supreme Court’s policy on bail, the court held that Gupta is entitled to bail, subject to standard conditions and verification of sureties.
Issues considered
- Whether bail should be granted in a case involving alleged sexual offence under IPC sections 69, 352 and 351(2) BNS.
- Whether the victim's statement indicating consent negates the seriousness of the offence for bail considerations.
- Whether the applicant’s lack of prior criminal history and the state of overcrowded prisons justify bail.
