Allahabad High Court

KULWANT SINGHversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail during the pendency of the trial, subject to prescribed conditions.

Summary

Kulwant Singh, an employee of the Defence Research and Development Organisation, was arrested in connection with a case registered under IPC sections 318(4), 338, 336(3) and 340(2) arising from a matrimonial dispute involving the informant's daughter. He applied for bail, claiming absolute innocence and alleging false implication motivated by personal animosity. The State opposed the bail, arguing the seriousness of the offences. The High Court examined the nature of the alleged offences, the evidence, the severity of potential punishment, and the applicant's right to liberty, concluding that bail could be granted without commenting on the merits. The Court ordered his release on personal bond with two sureties, subject to strict conditions to prevent tampering with evidence or intimidation of witnesses. The bail order also directed the trial court to expedite the trial and avoid unnecessary adjournments.

Issues considered

  • Whether the applicant is entitled to bail pending trial for offences under IPC sections 318(4), 338, 336(3) and 340(2).
