Allahabad High Court

HASAN ASIFversusSTATE OF U.P.

Decided

Holding

The bail application is allowed.

Summary

The High Court of Allahabad considered a bail application filed by Hasan Asif, who was in custody since 9 June 2026 for offences alleged under Sections 318(4), 336(3), 338, 340(2), 61(2) and 112 of the Indian Penal Code. The applicant claimed absolute innocence, asserting that the forged mark‑sheet was recovered from a co‑accused and that he had no involvement in the alleged crimes. The State opposed bail but did not refute the applicant’s factual submissions. After weighing the nature of the allegations, the period of custody, and the gravity of the offences, the Court, without expressing an opinion on the merits, found the case fit for bail. Consequently, the Court ordered the release of the applicant on personal bond and two sureties, subject to standard bail conditions. The Court retained the power to cancel bail if any condition is breached.

Issues considered

  • Whether bail should be granted to the accused in a case involving offences under Sections 318, 336, 338, 340, 61 and 112 of the IPC
  • Whether the applicant's claim of innocence and the circumstances of his custody justify bail
