Allahabad High Court
SHREYJAL @ SUJALversusSTATE OF U.P. AND ANOTHER
- Decided

- JAI PRAKASH TIWARI
Holding
The court granted bail to the applicant subject to bond, sureties, and conditions.
Summary
The applicant, Shreyjal @ Sujal, was arrested in connection with a case (Crime No. 329 of 2025) involving alleged offences under Sections 310(2) and 317(3), 317(4) of the Indian Penal Code. He contended that he was falsely implicated, not named in the FIR, and that the alleged recovery of contraband from his possession lacked any independent witness. The prosecution opposed bail but did not dispute the applicant's claim of innocence. The court, after reviewing the record and the nature of the allegations, decided that the case was suitable for bail without expressing an opinion on the merits. Accordingly, the bail application was allowed subject to a personal bond, two sureties, and specific conditions. The order clarified that the observations were limited to the bail application and would not affect the trial's merits.
Issues considered
- Whether the accused is entitled to bail despite being charged under Sections 310 and 317 of the IPC and having prior criminal cases
- Whether the circumstances of the alleged false recovery and lack of independent witness justify granting bail
