Allahabad High Court
SHREYJAL @ SUJALversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- JAI PRAKASH TIWARI
Holding
The court granted bail to the applicant.
Summary
The applicant, Shreyjal @ Sujal, was arrested in Criminal Case No. 219 of 2025 under IPC sections 310(2) and 317(3), 317(4). He contended that he was falsely implicated, was not named in the FIR, and that the alleged recovery of contraband from his possession lacked an independent witness. Although he has four prior criminal cases and has been in custody since 22‑12‑2025, his counsel argued that he is entitled to bail and will cooperate with the trial. The State opposed the bail but did not dispute the applicant’s contentions. After reviewing the record and the nature of the allegations, the court granted bail subject to personal bond, sureties and specific conditions, without expressing any view on the merits of the case.
Issues considered
- Whether bail should be granted when the accused claims false implication and lack of FIR naming.
- Whether the applicant's prior criminal history precludes bail.
- Whether the court can grant bail without adjudicating the merits of the underlying offence.
