Allahabad High Court

PRASHANT TIWARIversusSTATE OF U.P.

Decided

Holding

The court held that the applicant had made out a prima facie case for bail and granted bail.

Summary

The applicant, Prashant Tiwari, filed a bail application under Section 3(1) of the U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, seeking release while his trial is pending. He contended that the charges were based on police rivalry, that he had no gang affiliation, and that he had already been granted bail in related cases. The State opposed the bail, arguing the seriousness of the offence. The court, after considering the material and without delving into the merits, found that the applicant had made out a prima facie case for bail. Accordingly, the court ordered his release on bail subject to a personal bond, two sureties, and conditions not to tamper with evidence or intimidate witnesses. The order emphasized that any breach would lead to cancellation of bail and would not affect the trial on merits.
