Allahabad High Court
PADMDHAR SINGH @ YASH @ AMAN SINGHversusSTATE OF U.P.
- Decided
- Bench
- KRISHAN PAHAL
Holding
The Court allowed the bail application, granting bail to the accused subject to conditions.
Summary
The applicant, Padmdhar Singh, was arrested in connection with a case under Sections 2(B)(i) and 2(B)(ii) of the U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, and has been in custody since 11 May 2025. He filed a bail application asserting that the charges stem from a single criminal case already listed in a gang chart for which he had previously been granted bail, and contended that he was falsely implicated due to police rivalry and has no gang affiliation or prior criminal record. The State, represented by the Additional Government Advocate, opposed the bail on the ground that the offence falls under a stringent anti‑gangster statute. The Court, without delving into the merits of the allegations, decided to grant bail subject to a personal bond, two sureties, and conditions prohibiting tampering with evidence, intimidation of witnesses, and ensuring appearance before the trial court. The order also directed verification of the identity, status, and residence of the applicant and sureties before the bond is accepted. Breach of any condition would result in cancellation of bail.
