The court held that the applicant is entitled to be released on bail pending trial.
Summary
Irfan applied for bail in a criminal case (Crime No. 0095 of 2026) involving alleged offences under Sections 331(4), 305(a), 317(2) and 112(2) of the Indian Penal Code. He claimed absolute innocence, stating he was not named in the FIR, no incriminating material was found on him, and that the co‑accused had already been released on bail. The State opposed the bail, arguing the seriousness of the offences and the need to ensure trial integrity. The Court examined the nature of the alleged offences, the evidence presented, and the applicant’s criminal history, noting the heavy pendency of cases in the court. It concluded that, notwithstanding the seriousness of the charges, the applicant was entitled to bail during the trial, subject to strict conditions and sureties. Accordingly, the bail application was allowed and Irfan was released on personal bond with two sureties.
