Allahabad High Court

YOGESH KUMARversusSTATE OF U.P.

Decided

Holding

The court held that the bail application is a fit case for bail and allowed it.

Summary

Yogesh Kumar was arrested in connection with a case (Crime No. 06 of 2026) involving offences under Sections 115(2), 118(1), 118(2), 351(2), 352 and 109(1) of the Indian Penal Code. He sought bail, claiming innocence and arguing that co‑accused who faced identical charges had already been released on bail. The State opposed the bail but did not refute the applicant's factual submissions. The court examined the nature of the allegations, the gravity of the offences, the period of custody and the principle of parity with the co‑accused. Without expressing an opinion on the merits, the court found the case suitable for bail and imposed standard conditions to prevent tampering with evidence or intimidation of witnesses. Consequently, the bail application was allowed, subject to a personal bond and two sureties.

  • Whether Yogesh Kumar is entitled to bail despite the serious nature of the offences alleged against him
