Allahabad High Court

NEMCHANDversusSTATE OF U.P.

Decided

Holding

The court held that the applicant has made out a case for bail and allowed the bail application.

Summary

The applicant, Nemchand, sought bail in a criminal case (Crime No. 540 of 2025) involving offences under Sections 318(4), 338, 336(3), 340(2), 61(2) of the Indian Penal Code and Section 66D of the Information Technology Act. The court considered his criminal history, which was explained, and noted that bail cannot be denied solely on past offences if the bail criteria are otherwise satisfied. The applicant, an employee of HDFC Bank, claimed that a public welfare centre was handed over to a co-accused, and no merit of the case was decided. The court found that the applicant had made out a case for bail and ordered his release on personal bond and two sureties, subject to conditions of not tampering with evidence or intimidating witnesses. The bail was granted with a warning that breach of conditions would lead to cancellation.
