Allahabad High Court
MANVENDRA SINGHversusSTATE OF U.P.
- Decided

Holding
The court held that the applicant had made out a case for bail and consequently granted bail.
Summary
Manvendra Singh, the driver of a D.C.M. vehicle from which urea was seized, was charged under several sections of the Indian Penal Code, the Trade Marks Act and the Essential Commodities Act. He pleaded that he had no knowledge of the contraband and had no prior criminal record. The High Court examined the material on record and the submissions of counsel. Finding that the applicant had made out a prima facie case for bail, the court granted bail subject to a personal bond, two sureties and conditions not to tamper with evidence or intimidate witnesses. The order emphasized that breach of conditions would lead to cancellation of bail and did not prejudice the trial on merits.
Issues considered
- Whether bail should be granted to the accused during the pendency of trial for offences under IPC, the Trade Marks Act and the Essential Commodities Act.
- Whether the accused's claim of being merely a driver without knowledge of the contraband suffices to establish a prima facie case for bail.
