Allahabad High Court

RITIK KUMAR CHOHANversusSTATE OF U.P.

Decided

Holding

The court granted bail to the applicant, subject to bond and surety conditions.

Summary

Ritik Kumar Chohan applied for bail in Criminal Case No. 415 of 2026, charged under several IPC sections (318(4), 338, 336(3), 340(2), 61(2), 317(2) BNS) and Section 66D of the Income Tax Act, relating to transactions of Rs.13,000. The court noted that no FIR had been lodged against the applicant and the alleged loss was minimal. After considering the material on record and the arguments of counsel, the court found that the applicant had made out a prima facie case for bail. Consequently, the bail application was allowed subject to a personal bond, two sureties, and conditions not to tamper with evidence or intimidate witnesses. The order emphasized that the bail grant does not affect the trial on merits and that breach of conditions would lead to cancellation of bail.

Issues considered

  • Whether bail should be granted to the accused in view of the nature of the offences, the low quantum of the alleged transaction, and the absence of an FIR.
