Allahabad High Court

OM PRAKASHversusSTATE OF U.P.

Decided

Holding

The court held that the applicant had made out a case for bail and consequently granted bail.

Summary

The applicant, Om Prakash, filed a bail application in a case registered under Section 2(b)(xvii) and 3(1) of the U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986, alleging false implication and lack of prior criminal history. He had been in custody since 19 May 2026 and claimed that the prosecution was based on police rivalry and that he was not a gang member. The State opposed the bail, but the court, after considering the submissions and the material on record, found that the applicant had made out a prima facie case for bail. The court therefore allowed the bail application, directing the applicant to furnish a personal bond and two sureties, with conditions not to tamper with evidence, intimidate witnesses, or fail to appear. The order emphasized that breach of conditions would lead to cancellation of bail and would not affect the trial on merits.
