The court granted bail to the applicant subject to a personal bond, two sureties and conditions of non‑tampering with evidence and appearance before the trial court.
Summary
The High Court of Allahabad considered a bail application filed by Pradeep Kumar Saroj, who had been in custody since 14 July 2026 in a case under Section 3(1) of the Uttar Pradesh Gangster and Anti‑Social Activities (Prevention) Act, 1986. No counsel appeared for the applicant; the judge examined the record with assistance of a State Law Officer. The applicant’s affidavit indicated that the charge stemmed from a single criminal case listed in a gang chart, that he had previously been granted bail in that case, and that he had no prior criminal history. He undertook not to misuse liberty, not to tamper with evidence or intimidate witnesses, and offered two sureties. Without expressing an opinion on the merits, the court granted bail subject to a personal bond, verification of identity and residence of the applicant and sureties, and compliance with the stated conditions. Breach of any condition would result in cancellation of bail.
Issues considered
- Whether bail can be granted under Section 3(1) of the U.P. Gangster and Anti‑Social Activities (Prevention) Act, 1986 in the absence of a criminal history
- Whether the applicant’s undertaking and the provision of two sureties satisfy the conditions for bail
