Allahabad High Court

UMANG ALIAS VISHAL ALIAS SHAZEBversusSTATE OF U.P.

Decided

Holding

Bail is granted to the applicant on the ground of parity, subject to bond, sureties, and standard conditions.

Summary

Umang alias Vishal alias Shazeb applied for bail in a criminal case (Crime No. 20 of 2026) involving offences under Sections 318(4), 336, 338, 340(2) of the BNS and Sections 66C and 66D of the Information Technology Act, filed by the Cyber Crime Police Station, Muzaffarnagar. The applicant argued that he had no prior criminal record and that a co‑accused, Shahalam alias Rajeev Sharma alias Pradeep, had already been released on bail in a similar case. The Court examined the material on record, the submissions of counsel, and the principle of parity with the co‑accused. Finding that the applicant satisfied the criteria for bail and posed no risk of tampering with evidence or intimidating witnesses, the Court granted bail. The order directed the applicant to furnish a personal bond and two sureties, subject to standard bail conditions, and warned that breach would lead to cancellation of bail.

Issues considered

  • Whether bail should be granted to the applicant under the specified sections of the BNS and the Information Technology Act considering the seriousness of the offences and the applicant's lack of prior record.
  • Whether the principle of parity with a co‑accused already released on bail warrants granting bail to the applicant.
