Allahabad High Court

SUDHAKAR AND ANOTHERversusSTATE OF U.P.

Decided

Holding

The Court held that the applicants are entitled to bail during the pendency of the trial.

Summary

The High Court considered a bail application filed by Sudhakar and Surendra Bind, who were arrested in connection with a case (Crime No. 92 of 2026) involving alleged offences under several sections of the Indian Penal Code, including assault and criminal conspiracy. The applicants claimed innocence, alleging false implication due to a family property dispute and highlighted procedural lapses in the recovery of alleged weapons. The State opposed bail, arguing the seriousness of the offences and the risk of tampering with evidence. The Court examined the nature of the charges, the evidence presented, the applicants' lack of criminal history, and the prolonged pre‑trial detention. Balancing these factors, the Court concluded that the applicants were entitled to bail pending trial, subject to strict conditions. Consequently, the bail application was allowed without expressing any opinion on the merits of the case.

Issues considered

  • Whether bail should be granted to the accused in a case involving offences under IPC sections 109, 191, 115, 352, 351, and 333 despite the seriousness of the charges
  • Whether the alleged procedural irregularities and the claim of false implication justify bail
