Allahabad High Court

SHIVAM SONKARversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The applicant is entitled to be released on bail.

Summary

Shivam Sonkar, accused of offences under IPC sections 323 and 376 and POCSO Act sections 3 and 4, had been in custody since June 15, 2024. His first bail application was rejected on February 24, 2026. He filed a second bail application arguing that only four witnesses had been examined, there was no risk of evidence tampering, and the trial was unlikely to conclude soon, causing undue incarceration. The State opposed bail but did not dispute the facts. The Court, considering the nature of the offences, the lack of tampering risk, jail overcrowding, pendency of cases, and Supreme Court precedents (Kapil Wadhawan v CBI, Maya Tiwari v State of U.P., and the Suo Motu bail policy), granted bail with standard conditions. The order directed verification of identities, prompt release through the Bail Order Management System, and expedited trial within a year.

Issues considered

  • Whether bail should be granted to an accused of serious offences (IPC 323, 376 and POCSO 3/4) given the risk of evidence tampering.
  • Whether the applicant's prolonged pre‑trial detention is justified in view of trial delays and jail overcrowding.
  • Whether the applicant meets the criteria for bail under prevailing Supreme Court guidelines.
