Allahabad High Court

SURAJversusSTATE OF U.P.

Decided

Holding

The court held that bail should be granted to the applicant.

Summary

Suraj, a licensed Airtel Point of Sale (POS) agent, was arrested in connection with a cyber‑crime case (Crime No. 0042 of 2026) alleging offences under Sections 308(2), 318(4), 319(2), 61(2) of the BNS Act and Sections 66 and 66D of the Information Technology (Amendment) Act. He contended that he was falsely implicated, had no involvement in the alleged transactions, and no proceeds of the crime entered his bank account. The applicant had no prior criminal record and had been in custody since 18‑May‑2026. The court examined the seriousness of the charges, the period of incarceration already served, and the applicant’s claim of innocence. Finding no risk of evidence tampering or flight, the court granted bail on personal bond and two sureties, subject to standard conditions, without prejudice to the trial on merits.

Issues considered

  • Whether the applicant is entitled to bail despite the gravity of the alleged cyber‑offences under the BNS Act and the IT (Amendment) Act.
  • Whether the applicant's claim of false implication and lack of monetary benefit justify the grant of bail.
  • Whether the period of pre‑trial detention already served warrants release on bail.

merely operating as an authorized Airtel Point of Sale (POS) agent and has
no nexus with the alleged offence as splayed out in the FIR. It is further
pressed that no monetary transactions or proceeds of the crime have been
transferred to the applicant's bank account. Furthermore, the applicant has no
prior criminal history and has been languishing in jail since 18.05.2026.

5. Considering the facts and circumstances of the case, the submissions
advanced by the learned counsel for the respective parties, the nature of the
