Holding
The Court held that the applicant had made out a case for grant of bail and therefore allowed the bail application.
Summary
The High Court considered a bail application filed by Jamal Kha in a criminal case (Crime No. 93 of 2026) involving offences under sections 115(2), 352, 109(1), 125, 324(4), 351(3) and 3(5) of the B.N.S. The applicant claimed innocence, alleging false implication and that the aggressor could not be identified, while co‑accused had already been granted bail. The State opposed bail, asserting sufficient evidence of the applicant’s involvement. After reviewing the submissions, the record, and the applicant’s criminal antecedents, the Court found that the applicant had made out a case for bail. Consequently, the bail application was allowed subject to a personal bond, two sureties, and several conditions aimed at preventing tampering with evidence or intimidation of witnesses.
Issues considered
- Whether the applicant, Jamal Kha, is entitled to bail in the pending criminal case despite the serious nature of the charges and the evidence alleged against him.
