Allahabad High Court

SMT. SONIYA SANGWANversusSTATE OF U.P.

Decided

Holding

Bail was granted to the applicant subject to bond, sureties, and standard conditions.

Summary

Smt. Soniya Sangwan applied for bail in a case registered under Sections 2 and 3 of the Uttar Pradesh Gangster and Anti‑Social Activities (Prevention) Act, 1986. She contended that the prosecution was based on two earlier cases for which she had already been granted bail and that the present charge was a result of police rivalry, asserting she is not a gang member. The State opposed the bail, but the court, without delving into the merits, granted bail subject to a personal bond, two sureties, and conditions not to tamper with evidence, intimidate witnesses, or fail to appear. The court ordered verification of the applicant’s and sureties’ identity, status, and residence before accepting the bonds. Any breach of the conditions would lead to cancellation of bail.
