Allahabad High Court

SACHINversusSTATE OF U.P.

Decided

Holding

Bail was granted to Sachin on the condition of a personal bond and two sureties.

Summary

Sachin applied for bail in Criminal Case No.207 of 2026, facing a slew of charges under the Indian Penal Code, the Prevention of Damage to Public Property Act, 1984 and the Criminal Law Amendment Act. The court noted that co‑accused Monu Singh and Vikash had already been granted bail in a similar case and that Sachin had no prior criminal record. Without delving into the merits of the allegations, the court held that a prima facie case for bail existed on the ground of parity. Accordingly, bail was granted subject to a personal bond, two sureties, and conditions not to tamper with evidence, intimidate witnesses, and to appear before the trial court. The order also warned that breach of any condition would lead to cancellation of bail.

Issues considered

  • Whether bail should be granted to Sachin in view of the charges and the fact that co‑accused have been released on bail
  • Whether the principle of parity with similarly situated co‑accused warrants bail
