Holding
The court held that the applicant is entitled to bail during the pendency of the trial.
Summary
The Allahabad High Court considered a bail application filed by Sudhir in Criminal Case No. 139 of 2026, which is registered under Sections 309(4) and 317(3) of the Indian Penal Code. The applicant asserted that he is innocent, his name having surfaced only in a co‑accused’s confessional statement, and that he has been in custody since 6 July 2026. The State, represented by the learned A.G.A., opposed the bail. After weighing the nature of the offences, the evidence and the severity of the prescribed punishment, the court decided that bail could be granted without expressing any opinion on the merits of the case. The court ordered the applicant’s release on a personal bond with two sureties, subject to conditions such as non‑tampering with evidence, non‑intimidation of witnesses and appearance before the trial court. The order is confined to the bail application and does not affect the trial’s substantive merits.
