Holding
The court held that the applicant is entitled to bail during the trial, subject to strict conditions.
Summary
The High Court of Allahabad considered a bail application filed by Gulzar, accused in Criminal Case No. 451 of 2026 under Sections 61(2)Ka, 310(2), 311, 317(3), 317(5) and 336(2) of the IPC. The applicant asserted that he is innocent, was not named in the FIR and was implicated only through the confessional statements of co‑accused, and has been in custody since 23 June 2026. The State opposed bail, but the court examined the nature of the offences, the evidence, the severity of the punishments and the applicant’s criminal history. Balancing these factors and the heavy pendency of cases, the court held that the applicant is entitled to bail during the pendency of trial, without expressing any opinion on the merits. Accordingly, the court ordered his release on personal bond with two sureties, subject to conditions such as non‑tampering with evidence, non‑intimidation of witnesses and appearance before the trial court.
