Holding
The court held that the applicants are entitled to be released on bail during the pendency of the trial.
Summary
The High Court of Allahabad considered a bail application filed by Mohammad Ashgar @ Ajgar and another accused in a criminal case (Crime No. 64 of 2026) involving alleged offences under Sections 309(6), 331(4) and 317(2) of the Indian Penal Code. The applicants claimed innocence, alleged false implication, and asserted that the money recovered from them was their hard‑earned earnings unrelated to the alleged crimes. The State opposed the bail, but the court, after reviewing the record and the nature of the allegations, concluded that the applicants were entitled to bail pending trial. No opinion on the merits of the case was expressed. The court ordered release on bail upon execution of a personal bond and furnishing of two sureties per applicant, subject to standard conditions such as non‑tampering with evidence and appearance before the trial court.
Issues considered
- Whether bail should be granted to the accused pending trial for offences under Sections 309(6), 331(4) and 317(2) of the IPC.
- Whether the alleged false recoveries and the applicants' claim of innocence affect the bail eligibility.
- Whether the conditions imposed by the court are sufficient to safeguard the trial process.
