Allahabad High Court

SHREYJAL @ SUJALversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that the applicant is entitled to bail on the ground of parity with the co‑accused.

Summary

The High Court considered a bail application filed by Shreyjal @ Sujal, who was in judicial custody for a theft case (Crime No. 326 of 2025) involving the alleged snatching of an informant's bag. The applicant claimed innocence and argued that co‑accused Babu Pasi and Manish Chaturvedi had already been released on bail, creating a parity ground for his own release. The State opposed the bail, but the court noted the precedent of bail granted to the co‑accused and found no reason to deny the applicant. Consequently, the court ordered his release on bail subject to a personal bond, two sureties, and specific conditions to prevent tampering with evidence, ensure cooperation, and prohibit further criminal activity. The bail was granted with the usual verification of identity and residence of the applicant and sureties.

  • Whether the applicant is entitled to bail on the ground of parity with co‑accused who have already been released on bail
