Allahabad High Court

YUVRAJ SINGHversusSTATE OF U.P.

Decided

Holding

Bail was granted to the applicant on the condition of a personal bond and two sureties, subject to standard bail conditions.

Summary

Yuvraj Singh applied for bail in Criminal Case No. 144 of 2026, charged under several sections of the BNS and the Arms Act. The applicant had no prior criminal record, and a co-accused, Sarvesh @ Rahul Singh, had already been granted bail in a similar case. The court examined the material on record, the submissions of counsel, and the principle of parity with the co-accused. Finding that the applicant satisfied the criteria for bail, the court ordered his release on a personal bond and two sureties, subject to conditions not to tamper with evidence, intimidate witnesses, and to appear as required. The bail may be cancelled if any condition is breached, and the trial on merits will continue unaffected.

Issues considered

  • Whether bail should be granted to the applicant during the pendency of trial on the charges under Sections 115(2), 352, 351(3), 109(1), 61(2) of the BNS and Sections 3, 25, 27 of the Arms Act.
