Allahabad High Court
SUNEEL RAJPOOTversusSTATE OF U.P.
- Decided

Holding
The court granted bail to the applicant.
Summary
Suneel Rajpoot applied for bail in a case registered as Crime No. 03 of 2024, involving alleged offences under Sections 419, 420, 120‑B of the IPC and Section 66D of the Information Technology Act. The applicant argued that he was falsely implicated, not named in the FIR, and that the only basis for his involvement was a confessional statement of a co‑accused, which the court held to have weak evidentiary value. He also claimed ignorance of a Rs.20,000 transfer to his bank account and highlighted his clean criminal record and the period of detention already served since 4 July 2026. The court considered the nature of the offences, the lack of direct evidence, and the applicant’s lack of prior convictions, and found the case fit for bail. Accordingly, the bail application was allowed, subject to a personal bond, two sureties, and conditions not to tamper with evidence or intimidate witnesses.
Issues considered
- Whether bail should be granted in a case involving alleged cheating, criminal conspiracy and cyber‑cheating offences.
- Whether a co‑accused’s confessional statement, in the absence of the applicant’s name in the FIR, suffices to deny bail.
- Whether the applicant’s lack of prior criminal record and period of detention justify bail.

420, 120-B of IPC and Section 66D of I.T. Act, Police Station - Cyber
Crime Bareilly, District - Bareilly, during the pendency of trial.
4. Learned counsel for the applicant contends that the applicant has been
falsely implicated in the present case. It is submitted that the applicant is not
named in the FIR, and his involvement has been clean-slated solely on the
basis of the confessional statement of a co-accused, which carries no
evidentiary value in the eyes of law. It is further contended that while an
amount of Rs. 20,000/- is alleged to have been transferred to the applicant's
bank account, he had no knowledge regarding the source or the nature of the
said transaction. The applicant has no criminal history, save for one case
subsequently foisted upon him after the lodgement of the instant case. The
applicant has been incarcerated since 04.07.2026 and assures full
cooperation with the trial.
5. Considering the facts and circumstances of the case, the submissions
made by the learned counsel for the parties, the nature of the offence, the
severity of the punishment, and also considering the fact that the applicant is
not named in the FIR, the weak evidentiary value of the co-accused's
