Allahabad High Court
DEEPA AND ANOTHERversusSTATE OF U.P.
- Decided
- Bench
- VIVEK KUMAR SINGH
Holding
The court held that the applicants are entitled to bail.
Summary
The Allahabad High Court considered a bail application filed by Deepa and Preeti in Crime No. 477 of 2026, which involved alleged offences under IPC sections 191(2), 191(3), 115(2), 127(2), 109(1) and 351(3) B.N.S. The applicants contended that they were falsely implicated in a matrimonial dispute, had been incarcerated since 23‑08‑2026, and possessed no criminal antecedents. The State opposed bail, asserting that ample evidence linked the applicants to the offences. After evaluating the nature of the accusations, the evidence, the length of detention and the applicants' clean record, the Court held that they had made out a case for bail without expressing an opinion on the merits. Consequently, the Court ordered their release on personal bond and two sureties each, subject to strict conditions regarding court attendance, non‑adjournment, and consequences for any breach, while noting that these observations would not prejudice the trial judge’s independent assessment.
Issues considered
- Whether bail should be granted to the accused despite the seriousness of the alleged offences under IPC and B.N.S. provisions.
- Whether the invocation of Section 109(1) B.N.S. to deny bail was appropriate.
- Whether the period of pre‑trial detention and the absence of prior criminal history justify the grant of bail.
- What conditions, if any, should be imposed on bail under the Cr.P.C. and IPC.
